Media Usage Policy

1. Media Ownership & Copyright

All media produced by Spectre Films and Victory Power Network is copyrighted:

2. Client-Commissioned Media Rights

When Spectre Films or Victory Power Network creates media for a client under a contracted agreement:

• Deliverables Ownership: Upon full payment as specified in the contract, client receives exclusive ownership of final deliverables (edited video, photographs, broadcast content)
• Usage Rights: Client may reproduce, distribute, and modify deliverables for uses specified in the contract
• Exclusivity: Unless otherwise stated, Spectre Films or Victory Power Network retains non-exclusive rights to use materials in portfolio and marketing (anonymized where necessary)
• Talent & Licensing: Client is responsible for obtaining all necessary talent releases, music licenses, and third-party clearances
• Partial Payment: Ownership transfer requires full payment; incomplete payments do not transfer IP rights

3. Production Materials & Raw Footage

Regarding raw footage, unedited material, outtakes, and production assets:

• Ownership: Raw footage and production materials remain the property of Spectre Films or Victory Power Network unless explicitly transferred in writing
• Client Access: Clients receive access to raw materials for archival purposes only unless licensed separately
• Editing Rights: Client may request custom edits; additional edits beyond contracted scope are billable
• Retention: Raw materials are retained for 2 years for potential re-licensing or archival

4. Victory Power Network Broadcast Rights

For livestreams and broadcasts on Victory Power Network:

• Broadcast License: Victory Power Network grants broadcasters a non-exclusive, revocable license to stream on our platform
• Archive Rights: Victory Power Network may archive broadcasts for replay, clips, and analytics purposes unless explicitly prohibited
• VOD (Video on Demand): Broadcasters retain VOD rights for 30-90 days after live broadcast (or as specified in contract) unless extended
• Clip Licensing: Victory Power Network may create clips and highlights for promotional use (with broadcaster credit)
• Removal Rights: Broadcasters may request content removal within 90 days; archival retention may apply per platform policy

5. Talent, Model, and Rights Clearances

Clients and broadcasters are responsible for:

• Obtaining signed talent releases and model releases for all individuals appearing in media
• Securing synchronization (sync) licenses for any music used in productions
• Obtaining performance rights from composers/publishers for music
• Clearing all third-party intellectual property rights (logos, artwork, copyrighted content)
• Ensuring all media complies with local laws, regulations, and broadcasting standards
• Providing evidence of clearances upon request (e.g., talent releases, music licenses)

Spectre Films and Victory Power Network will not be held liable for clearance violations.

6. Photography & Editing Rights

For photography services (Spectre Films):

• Edited Photos: Client receives full ownership and usage rights for contracted deliverables
• Raw Files: Provided upon request; raw/unedited files remain Spectre Films property unless otherwise specified in contract
• Printing Rights: Client may print and display photos as specified; unauthorized commercial reproduction is prohibited
• Modification: Client may modify delivered photos for personal/commercial use within contracted scope
• Attribution: Where applicable, Spectre Films requests credit as photographer

7. Publishing & Distribution Rights

For media published on Victory Power Network or delivered through Spectre Films:

• Distribution Channel: Victory Power Network maintains the right to distribute content across multiple platforms (YouTube, Twitch, social media) unless restricted in writing
• Multi-Platform: Content may be repurposed for shorts, clips, social media, and promotional materials
• Exclusivity: Unless contracted otherwise, Victory Power Network is non-exclusive platform (broadcaster may publish elsewhere)
• Geo-Blocking: Victory Power Network may enforce geo-restrictions or availability windows per contract

8. Monetization & Revenue Sharing

9. Prohibited Uses

Unauthorized use of Spectre Films or Victory Power Network media includes:

• Redistributing copyrighted content without proper licensing
• Reproducing for commercial purposes without permission
• Removing or altering copyright notices and metadata
• Deep-linking or embedding content to bypass platform controls
• Creating derivative works without consent
• Using media for political, religious, or controversial purposes (unless authorized)
• Misrepresenting authorship or falsely attributing content

10. Content Takedown & Removal

Spectre Films and Victory Power Network reserve the right to:

• Remove content that violates this policy or platform terms
• Demonetize or restrict content for policy violations
• Enforce takedowns for copyright infringement (DMCA compliance)
• Archive content for compliance/legal hold purposes
• Honor removal requests from subjects of media (within legal limits)

11. Attribution & Credits

Spectre Films and Victory Power Network request proper attribution where feasible. Credits should appear as:
